Police told reporters that Mario Rosario Sr., 24, was riding south on Bailey Avenue with his 4-year-old son, Mario Rosario Jr., when the scooter was involved in a crash with a Toyota driver near West 193rd Street. The Daily News and Gothamist reported that Toyota driver William Baez, 51, was trying to turn left onto West 193rd Street.

The child passenger died at the hospital

News reports identified the child as Mario Rosario Jr. and said medics took him to St. Barnabas Hospital, where he died after suffering severe head injuries. The city record identifies the fatality as a 4-year-old male passenger.

Sources described the child’s position differently: the city record says he was seated on another person’s lap, while news reports described him as riding on the back of the scooter or behind his father.

Police made arrests after the crash

Police arrested Rosario Sr. after saying the scooter was stolen. Gothamist and the Post reported that he was charged with criminal possession of stolen property and endangering the welfare of a child; the Daily News reported the child-endangerment charge.

Police also arrested Baez. Gothamist described the charge as driving without a license, while the Post reported an aggravated unlicensed operation charge and said police described his license as suspended.
