The Daily News, citing police, reported that a truck driver hit the pedestrian around 3:55 to 3:57 a.m. and continued away from the scene. The later Daily News account said the pedestrian had bent down to pick up food he had dropped.

The sources differ on the driver’s movement. The city record lists an eastbound driver making a left turn in a 2017 Mack dump truck; the Daily News reported that police described a northbound driver making a right turn from Woodpoint Road onto Withers Street.

Police later located and interviewed the driver

The Daily News reported that police later located the 49-year-old Mack truck driver and interviewed him. Police said the driver told investigators he had been unaware he hit the crouching pedestrian.

The pedestrian was taken to Elmhurst Hospital Center, where he died, according to both Daily News reports.

Investigators cited the pedestrian’s position and the driver’s account

The later Daily News report said police were examining how the pedestrian came to be crouching in the roadway while picking up dropped food. The city person record lists pedestrian error or confusion as a contributing factor.

Police said the driver told investigators he did not know he had hit anyone. The Daily News reported on March 3 that he had not been charged and that police were still investigating.

Witnesses described a blocked-off intersection

A nearby resident told the Daily News that the intersection was blocked off after the crash, with police, highway patrol and detectives at the scene. Another resident called the crash tragic and said the block was generally quiet at night.
